CNN call him a Linux hero, but local government inspector wants to shut him down

James Burgett runs the Alameda County Computer Resource Center which takes computers destined to become landfill and installs Linux on them and then gives them out to schools, non-profits, and poor people. CNN calls him a hero, an interview with Burgett is currently leading a CNN contest among videos of ‘ordinary people’ whom CNN considers everyday heroes, narrowly edging out the video of a man who is saving gorillas from extinction.

But according to an article on the O’Reilly Radar a local government inspector from the Department of Toxic Substance Control of the California Environmental Protection Agency has handed James a Section 1 violation, which means they can shut him down or make it very hard for him to stay in business.

It is all to do with Jame’s inventory of parts. This is a quote from the DTSC finding. “Compliance Action: ACCRC shall develop an inventory for all items set aside for possible use by Aftermath Technologies and for donation/development of a museum, etc. The inventory shall be submitted to Asha Arora C/o DTSC, 700 Heinz Avenue, Berkeley, CA 94710 within 30 days of receipt of this report. In addition, ACCRC shall ensure that those universal wastes are not accumulated onsite for longer than one year.”

    These are not “universal wastes” until designated as “waste” - if they are truly “items set aside for possible use… and for donation/development of a museum” then the inspector has their head up their arse!

    Goes to show that government doesn’t really care about people at all. This guy is doing something to help the disadvantaged and they want to shut him down. I don’t know about anyone else but I’m getting tired of all of this crap. America’s State, Local and Federal Governments are supposed to be By The People and For The People, but that hasn’t been the case for a long time now and its got to stop.

    Joe Polk — thats not liberalism you idiot, its environmental protection issues. the problem is not in the “liberal” desire to protect the environment, its in how it was crafted.

    Now you have to trust that the people who are in charge of things, don’t keep their head stuck up their asses, and make a good faith judgement on the situation.

    The regulations were put in effect to make sure that huge entities (such as businesses who don’t want to do the right thing, and just dump toxic waste where ever they want) have to make sure that everything is taken care of and cleaned up after they’re done using it.

    The DTSC is doing their job. we can only hope (and maybe even write a letter to them!!!) that they come to understand what is going on, and don’t fuck up a good thing.

    stop blaming liberals because your neo-conservative corporate centric mind has trouble thinking through the cause and effect of things. The DTSC policy was probably written because some huge multinational corporation dumped all of their waste in a lake somewhere thinking no one would notice.

    duran, Who do you think made those laws? or pushed them to get approved? We understand why they are in place, but you fail to see the irony in the situation. Everyone knows liberals push their own views when they get elected and don’t care what they ran on. It’s an old story that everyone knows.

    What a low blow on liberalism. Protection of the environment is everyones concern, its something we all live in. This issue was most likely brought up by some fat cat conservative. Shutting him down to increase their business profits was probably the motive. The first school that didn’t sign a deal to buy all new computers sent the rich in fear of not getting that new toy, and research on possibilities to stop this from happening commenced. If it wasn’t the EPA issues being brought up it would have been something else.

    Joe Polk - go to any 3rd world country that has no water quality or air quality laws and try drinking the water and breathing the air and maybe you’ll understand why these laws exist. Are you familiar with tragedy of the commons? When the destruction of a shared resource will result in only a benefit to one individual, that individual will choose destruction of the resource in order to help his own situation - it happens all the time.

    It really doesn’t surprise. Council staff are surely bred on bureaucracy and towing a line, no matter how ludicrous? There’s no room for creative thinking in that sort of environment in many I’ve had to deal with. To be fair, though, it’s the size of the organisation - large private companies have the same issue. Jobsworth and all that. 2c.

    I think it is insult to united states which states that freedom is its first priority. Such incidents must be avoided and people must be given more freedom to do business. That too he is doing service to people who are in need. This is a good act. Govt must support him not throw stones on him

    Folks -

    Think about the way Microsoft licenses products to schools. Because M$ has bullied the school district into blanket licenses, the schools need to abide by the terms, which often say NO NON-MS COMPUTERS MAY BE OPERATED. This guy is trying to do the right thing, but the press he just got will have M$ vultures - I mean lawyers - all over this. The schools will start to refuse his donations anyway, for fear of losing their M$ licenses.

    The outcome of the complaint doesn’t matter, the press it has received has doomed Burgett. A quick look over the CA DTSC reveals close Microsoft ties - like most government agencies.

    NACK: I’m glad somebody pointed that out. I’m no conservative, but I just about had an embolism when I read KALIFORNIA’s post.

    Liberal = Liberal amounts of government
    (This is why conservatives constantly complain about “big government”)

    Conservative = Conservative amounts of government
    (Liberals choose to interpret this as letting corporate America do whatever the hell it wants)

    Libertarianism = Government doing exactly what is was specifically intended to do, nothing more and nothing less. Let the masses work out the rest for themselves like intelligent human beings.

    A possible solution would be for the ACCRC to establish the fiction that they are purchasing the scrap computers (for $0.001 each), thereby intercepting them before they become “waste.” A better solution would be for the Governator to order the beaurocrats to cut the crap or find themselves transferred to positions of zero authority and shitty working conditions. Whether he will do so will depend on how much he owes to Microsoft and the hardware manufacturers.

    Are you out of your damn mind? Do you honestly think that this sort of behavior is exclusive to “liberals”? Have you been living in a Cracker Jack box your whole life? All of them from both parties do these things and more.

    If you are a member of either party you are a tool in the most literal sense of the word. You are being used. You allow it. And if you are on a page like this defending your party or even worse attacking the other puppets, I mean party members, then that means you not only allow it but you like. If you try to apply your petty little partisan philosophy to things like this, then I’m afraid there is absolutely no hope for you. You are lost.
    If this is the unfortunate reality you are confronted with, this is my humble (but logical) advice for you. Stop eating. Stop drinking water, and if you could, stop breathing. These are all requirements for life and those of us who choose to actually live our lives and think for ourselves are going to need them to survive. If you think life is a game, then please go play somewhere else. Because the rest of us are not having fun.

    I’ll bet Microsoft has much more “toxic waste” stored on desks inside their buildings than ACCRC has in it’s inventory warehouse.

    Perhaps ACCRC just needs to place their computers on desks also.
